中文摘要 在我国社会转型、体制转轨、政府转变职能的变革时期，关注并认真解决 弱势群体问题，是保障人权、维护社会稳定、实现经济社会可持续发展，构建 和谐社会的重要任务之一。本文从法律视角，以人权价值为理论基础，以党和 国家保护弱势群体的方针政策为指导，理论联系实际，综合运用文献索引、数 据统计、实证分析等研究方法，对弱势群体问题进行了全面、深入地分析。 弱势群体问题凸显，既有历史原因，也有现实因素，问题错综复杂，涉及 面广，解决难度大。依法保护弱势群体的权益是彻底解决问题的根本途径。本 文从这一角度出发，对构建弱势群体法律保护问题进行了探索。 全文本论共分五部分。其中第一部分是对弱势群体的界定。提出法学意义 上的弱势群体是指由于自然、社会或其它原因，其生存权和发展权得不到享有 和难以实现的群体。第二部分分析了我国弱势群体权利保护的法理基础。这是 本文的理论基础。第三部分介绍了国外弱势群体法律保护的现状。第四部分是 对我国弱势群体法律保护的现状与不足分析。第五部分针对我国弱势群体法律 保护的现状与不足，提出从提升法律效力等级、深化医药卫生体制改革、健全 社会保障体系、扩大就业、改革收入分配制度、完善自然灾害应急救助法律体 系等六个方面完善我国弱势群体法律保护体系。这是本文的重点和难点，也是 本文的结论。 关键词：弱势群体；人权；法律保护；和谐社会 I Abstract During the changeable period of social transformation, institutional transformation and the government changing function in our country.
