摘 要 摘 要 当今社会，跨国犯罪日益猖獗，犯罪嫌疑人往往通过各种途径逃至国外以逃避法律 的制裁。为了有效遏制这种势头，需要的是世界各国的通力合作。作为国际社会打击跨 国犯罪的重要手段，引渡制度已经在世界大多数国家建立起来。我国也不例外。但是随 着时间的推移与国际引渡合作的广泛开展，我国引渡制度的一些问题已经显现出来并逐 渐成为我国进行引渡合作的障碍，因次有必要对我国的引渡制度加以完善以便更好地发 挥它的作用。本文以国际刑法关于引渡的基础理论为研究起点，通过对于国外引渡合作 的新发展以及我国引渡制度现状的分析，找出我国引渡制度存在的问题，找出我国引渡 立法的不足，从而进一步提出针对性的完善措施。 笔者相信，随着引渡制度研究的不断深入，我国引渡制度必将不断完善，随着时间 的推移，我国引渡制度所存在的问题必将会得到妥善的解决。 关键词 引渡 司法协助 完善 I Abstract Abstract Todays society, rampant transnational crimes, the suspects fled abroad, often through various means to evade the law.
