摘 要 在我国，土地对于农民来说具有多重功能，既是生产资料，又是农村社会保 障的载体。然而城市化进程的加速使农民面临因征地而失去土地的危险，土地征 收制度的不完善加剧了被征地农民权益的损害，他们沦落为“种田无地、上班无 岗、低保无份”的“三无”人员。农民失地又得不到妥善的安置将会危及到社会 的稳定。尽管新颁布的《物权法》对土地征收制度作出了新的规定，但是对被征 地农民的保护仍显不足，需要相配套制度进一步予以完善。形势所迫，压力所迫， 中国土地征收制度的改革如箭在弦上，不得不发。 本文旨在通过考察国外土地征收制度，对其理论与实践进行分析，总结其优 长，以期阐明我国土地征收制度中存在的问题，分析原因、以尽快完善我国土地 征收制度。文章首先是对国外土地征收制度的考察，主要是通过对英国、法国、 德国、日本及韩国这几个土地征收法律规定较完备的国家予以介绍，从中得到一 些启示，以利于我国土地征收制度的借鉴。然后是对我国土地征收制度的现状进 行分析，对我国土地征收制度的内容作了全面的介绍，集中分析和探讨了该制度 存在的弊端及其原因。最后是通过制定《土地征收法》、明确公共利益范围、严格 土地征收程序、科学制定土地征收补偿机制以及对被征地农民予以司法援助等几 个方面来完善我国的土地征收制度。 关键词：土地征收；公共利益；征地程序；征地补偿 I Abstract In China, land has multiple functions for peasants: On one hand, it is the means for production; on the other hand, it is the important means livelihood.
