摘要:《劳动法》在赋予劳动合同法律约束力的同时, 也赋予了劳动合同当事人有条件的单方解除权和协商解除权, 同时还明确规定了用人单位不得解除劳动合同的特别情形。在当今中国的劳动力市场上, 供求比例悬殊很大, 供远远大于求。很多学历很高的劳动者为了找到工作, 不得不放弃自己所擅长的专业技能, 降低自己的条件, 来满足用人单位工作岗位的要求,学历高的劳动者尚且如此, 大量的大、中专毕业生、外地务工人员就更得委屈自身而“求”到工作了。用人单位正是抓住了广大劳动者的这一求职心切的心理, 大肆利用目前所处的雇佣优势地位, 凌驾于劳动者之上, 特别是在与劳动者解除劳动合同时, 不按照《劳动法》的规定, 随意或强行与劳动者解除劳动合同。对于用人单位合法解除劳动合同的,法律应该对其行为应给予确认和保护。同时,用人单位应当依照国家有关规定给予经济补偿。对于用人单位非法解除劳动合同的,法律予以否定和制裁。
