论我国刑法对私营企业的保护 法学专业学生 陆辉 指导教师 刘方启 摘要：私营企业迅速发展壮大，业已成为市场经济的重要组成部分，我国对私营企业的政策导向从“引导、监督、管理”发展为“鼓励、引导、支持”。因此在80年代到21世纪初先后制定了调整私营企业发展的法律规范。不容忽视的是，对私营企业的法律保护取得显著进步的同时，也存在很多问题，例如：一方面我们的一些法律仍然存在片面的保护国有财产的倾向，忽视私营企业的应有的平等权益。另一方面，由于我们对国有企业的不平等的照顾，要求国有企业承担更多的社会责任，有时反而使私营企业在事实上的法律权益高于一般的国有企业。 关键词：私营经济Discuss the protection of the private enterprise of criminal law of our country Student majoring in Law LU Hui Tutor LIU Fangqi Abstract：The private enterprise develops rapidly, has already become the important component of market economy, policy guidance on it is for private enterprise in our country from lead, supervising, management develop into encourage , lead , support of. On the other hand, because we require the state-owned enterprise to bear more community responsibility to the unequal treatment of the state-owned enterprise , make the enterprise run by the local people higher than the general state-owned enterprise in the legal rights and interests in fact instead sometimes. This text wants to discuss from the legal protection to the private enterprise of our country of legislative progress and the defect and some questions of noticing of the private enterprise of our country.
