南通职业大学 建筑工程学院 毕 业 论 文 题目：论商品房消费者权益的保护 系 部： 建筑工程系 专 业：房地产经营与估价 学 号： 1104052124 学 生： 李凯 指导教师： 王志磊 起止日期：2013年12月至2014年3月 中文摘要 近年来，随着我国房地产经济的发展和住房制度改革的深入，房地产交易同趋频繁、活跃，商品房消费也成为许多人一生中较为重要的消费行为。然而我国商品房市场中种种不规范现象导致商品房消费者的生命财产安全权、公平交易权等权益受到直接损害，房地产市场秩序混乱的问题还未得到根本解决，严重影响到消费者基本生存权利的实现，限制了广大人民群众生活水平的进一步提高。这一状况，不仅侵害了消费者的生存利益，而且不利于房地产业的健康发展和城镇住房制度改革的不断深化。因此加强对商品房消费者的保护已刻不容缓。本文首先研究商品房消费者的权益，分析了商品房消费者权益的内涵和特点，然后通过考察在商品房买卖过程中侵害消费者权益的具体现象，分析导致商品房消费者权益受损的原因，即市场经济形态下消费者的弱者地位、立法不完善、房地产市场监管不力以及商品房自身特点等，进而提出了对商品房消费者权益进行保护的必要性。文章接着指出目前我国商品房买卖中消费者权益保护的的诸多不足，例如《消费者权益保护法》中商品房消费者保护主体地位不明确，权利内容不完善；商品房消费者权益保护法律、法规、规章等之间还存在着较严重的法律冲突等等。针对这些情况，文章最后提出了要从立法保护、司法保护、社会保护以及政府保护等方面加强对消费者权益的保护，以期建立覆盖全社会的全方位、多层次、立体化的保护体系，使得商品房交易过程中侵害消费者合法权益的情况减少，即使开发商等有侵害消费者合法权益的行为，消费者也能够以明确的相关法律为依据维护自己的合法权益，从而促进商品房消费者权益的保护，进而促进我国房地产事业乃至整个国民经济的健康有序发展。 关键词：商品房消费者；权益保护；完善In recent years, with the development of Chinas real estate and the in-depth reform of the housing system, the real estate transactions become more frequent, active, commercial housing consumption has become the consumption behavior is more important in the life of many people.
