WTO背景下农村土地承包经营法律问题的研究.pdf

提 要 上地问题涉及到 “三农”问题的根本。本文结合入世的大背景，讨论了农村 土地承包的相关法律问题。论文共分三部分。第一部分讨论了入世和农村土地承 包之间的关系，指出了新形势下研究农村土地承包问题的必要性和紧迫性。一方 面，入世加快了农村的市场化进程，而土地作为最重要的生产要素，入世必将加 速其流转，给农村的土地承包关系带来巨大影响。另一方面，完善有关农村土地 承包的法律法规，稳定农村土地承包关系，对于加快实现农业现代化以应对WTO 挑战，具有重要的意义。第二部分为文章的主体:首先追本溯源，说明了农村土 地承包的由来，对其概念和范围进行了界定，并且就土地承包合同的性质进行了 探讨;接着经过论证，确定了农村土地承包经营权的物权性质并分析了其意义; 最后论述了土地承包经营权流转的方式和特征以及对土地承包经营权流转的限 制。第三部分结合我国的物权立法，提出了关于土地承包的制度选择，并就农地 所有权主体农村土地承包经营权流转及土地承包合同纠纷等问题提出了具体的 法制建议。 文章认为，确立土地承包经营权的物权性质，有利于保护农民的相关土地权 利，提高其积极性，实现农业的第二次飞跃。而要达此目的，则要从司法和执法 的实践做起，以土地承包合同为切入点，通过调解、仲裁和诉讼等方式来解决有 关土地承包合同的纠纷，化解矛盾，稳定农村土地承包关系，其中特别要注意发 挥调解和仲裁的作用。 Abstract Theissueofrurallandinvolvestheessenceofthequestionsannong CombiningthebackgroundofenteringtheWTO,thisthesishasdiscussedlegalissues concerningthelandcontractinthecountryside.Thethesisisdividedintothreeparts.
