 内 容 摘 要 在国家大力提倡节能减排、绿色出行的大环境下，拼车、搭乘等现象明显呈上升趋 势，好意搭乘便是其中较普遍的一种。好意搭乘行为不仅展现了中华民族助人为乐的高 尚品德还给人们的出行带来了方便，但同时也引发了一系列的问题。本文中例举的三个 案例都与好意搭乘相关，法院判决却相异，由此引发了笔者的思考。希望通过该论文让 更多的学者关注和研究好意搭乘，早日完善相关立法。 本论文除引言之外，正文共分为五个部分： 第一部分，案例情况及争议焦点。该部分介绍了三个与好意搭乘相关的案例及法院 的判决。通过对比分析这三个案例的判决，总结出三个案例的主要争议焦点，即何为好 意搭乘，由好意搭乘引发的损害应如何适用法律规则。 第二部分，好意搭乘的基本概念。该部分从定义、特征、法律性质三个方面对好意 搭乘的基本概念进行了界定。本文将好意搭乘定义为一种施惠关系，即施惠人与受惠人 之间是基于道德互助行为而产生的社会关系。将好意搭乘过程中发生损害界定为由同乘 行为和侵权行为共同构成。 第三部分，好意搭乘的类型化分析。该部分依照履行标准、时段标准、车辆实际控 制标准、事故责任标准分别对好意搭乘进行了分类。如此，是为了分类探讨法律对好意 搭乘行为的调控范围和程序，以及当事人之间的责任分配与平衡问题，为司法实践提供 可量化的依据。 第四部分，好意搭乘中相关法律问题分析。好意搭乘行为类型复杂多样，且承载着 道德因素，法律在介入时有一定的特殊性。该部分从责任基础、主体界定、风险分配、 特殊情节四个方面阐述了好意搭乘行为在法律层面上的特殊性，旨在能够更好地平衡当 事人双方利益，以便有较好的社会效果。 第五部分，关于完善我国好意搭乘制度的几点意见。目前，我国对好意搭乘并没有 明确的法律规定，各地司法实践也比较混乱。好意搭乘问题不仅关系到法律的严肃性还 关系到社会高尚道德地发扬与传承，应于立法中予以明确规定并就此提出相关建议，希 望能对相关立法有所裨益。 关键字：好意搭乘；法律责任；类型化分析；过错；归责原则 1 Abstract Today, the government strongly advocates energy saving and emission reduction through all the nation. So the phenomenon of pick-up and hitchhiking obviously presents upward trend. Goodwill pick-up is just part of more common. The behavior of goodwill pick-up not only brings convenience to people’s travel but also shows traditional virtues of kindness in china. But it also causes a series of problem. Three dissimilar judgments of tree similar cases led the writer’s thinking. The writer hopes that through this thesis to teases legal issues of goodwill pick-up and contributes a little strength for establishing goodwill pick-up legal system. Except the introduction, this thesis is divided into five parts: The first part, cases introduce and dispute focus. Through analysis the main dispute focus of the three referenced cases to clarify theoretic problem of goodwill pick-up. The second part, the basic concept of goodwill pick-up.
