PAGE \* MERGEFORMAT I 摘要 言论自由是宪法赋予每一位公民的一项政治权利, 言论自由作为一项重要的权利，越来越成为热门的话题。它的行使也是社会民主化的一个重要标志, 但权利的行使不是无边无际的。自由只能是法律下的自由，自由在有所制约的条件下才能有所保障，同样，言论自由在法律的框架下也要有一定的限度，这种限度来自法学理论本身的要求，也同样来自其他权利对其之约束。既然言论自由必然是法律下的自由，故对其之规范也即非常重要。本文旨在对言论自由权利的界限进行界定, 从而充分阐释言论自由的范围。对 于研究言论自由的范围与界限以及言论自由保护的研究都有现实的借鉴意义。本文从论述言论自由的含义，对国家，社会和个人的价值出发揭示出言论自由的重要作用和无限魅力。然而，任何自由和权利的行使都有限度，本文的第二章论证了对言论自由划分界限的必要性。最后，在对已有理论和实践进行梳理和总结的基础上，提出划分言论自由的原则和几点对元论自由界限划定的建议。其背后所追求的目的是唯一的，那就是使言论自由能够得到更好的保护。 关键词: 言论自由;权利; 界限 ABSTRACT Freedom of speech is a political and constitutional right of every citizen, freedom of speech as an important right, has increasingly become a hot topic. The exercise is also an important symbol of social democracy, but the exercise of rights is not boundless. Freedom is freedom under the law, to be free in the constraint conditions is guaranteed, the same, the freedom of speech under the framework of the law also should have certain limit, the limit from the legal theory itself, but also from other rights restriction on them. Since the freedom of speech is the inevitable result of freedom under the law, so the standard is very important. The purpose of this paper is to define the boundaries of the right of free speech, which fully explains the scope of freedom of speech. This paper expounds the meaning of freedom of speech, the state, society and individual value of the important role of revealing speak on freedom and the infinite charm. However, to exercise any rights and freedoms have limit, the second chapter of this paper demonstrates the necessity of free speech partition boundaries. Finally, on the basis of summarizing the existing theory and practice, propose to delineate division principles of freedom of speech and freedom of element on the boundaries of several suggestions.
