摘 要 自2005年以来，索马里海域频发武装劫船事件。面对日益猖獗的海盗，现阶段由1958年《公海公约》、1982年《联合国海洋法公约》和1988年《位与缺位。1958年《公海公约》、1982年《联合国海洋法公约》和1988ABSTRACT Since 2005, incidents of armed robbery against ships off Somalia coast frequent. Facing such facts, internatinal pirates law, consists of 1958?Geneva?Conventions?on the Law of the?Sea, 1982 United Nations Convention on the Law of the Sea and the?1988 Convention?for the?Suppression of Unlawful Acts(SUA) Against the?Safety of Maritime Navigation, appears to have a weak force against pirates and cannot stop Somali pirates effectively. Accordingly, United Nations Security Council resolution authorise military actions against the offense. At the present stage, pirates’ upward trends to be controlled, but it is far away from completely resolving this threat. Practice has revealed the?deficiencies of international legal system in the fight against piracy. So as to provide theoretical support for the settlement of pirates, scholars focus on how to improve the existing regulation of the international pitares law. That is also the purpose of the Article. The author analyzes the status and causes of the Somali pirates to demonstrate that the absence of internatioanl law has left a living space for pirates. Such absence shows the imperfect of pirates governing systerm, indicates the lack of Piarte Disposal Act and highlights the maritime delimitation disputes under international law. By in-depth analysis of the Somali pirates for the challenges of todays international law, the Article describs the bit and absence of the current pirates law, point out that international law hampered the action against Somali Pirates. After discussing the status and problems of the current military action against Somali pirates?, the author also proofs the new development of today’s internatioanl law during the military operations.
