中南民族大学 硕士学位论文 试论当代中国村民自治权的法律保障 姓名：吴瑶 申请学位级别：硕士 专业：法学理论 指导教师：王瑞龙 中南民族大学硕士学位论文 摘　　要　 村民自治制度是社会主义基层民主政治的重要制度，村民自治权是村民自治 制度中的重要概念，只有保障了村民自治权，才能更好的促进村民自治的民主化、 法治化进程。目前，对于村民自治的研究很多学者都是从社会学或政治学的角度 给予阐述的。本文试图从法学的角度，以村民自治权作为研究的切入点，对村民 自治权法律保障的相关问题进行探讨，以期对完善我国村民自治制度，保障村民 自治权的实现有所裨益。 文章除了引言部分外，分为三个部分： 第一部分：分析村民自治权的概念。本章从村民自治的界定入手，阐述村民 自治权的概念和特征。村民自治是村落居民遵守法律和村民公约或章程自主地决 定管理自身事务，村民自治权则是村民通过村民个体或者村民自治组织依法处理 与村民利益相关的村内事务的自治权利。笔者认为，村民自治权的特征表现为： 权利的法定性、主体的双重性、内容的多样性。村民自治权的主体包括村民个人 和村民集体；村民自治权的行使内容包括选举权、管理权、决策权、监督权等。 第二部分：考察中国当代村民自治权的法律保障的状况。村民自治权的法律 保障虽然经历了产生，发展与完善的过程，但是，目前我国村民自治权的法律保 障依然存在一些问题，这些问题突出表现在：民主选举权中的贿选界定，贿选的 处罚措施；违反民主决策行为的法律效力的确定；民主监督机制的失落等。 第三部分：提出完善我国村民自治法律保障的建议。针对村民自治权法律保 障存在的问题，完善我国村民自治权法律保障应当：明确界定贿选的概念、明确 贿选查处主体的权责规定、明晰贿选的相关处罚规定；确认违反民主决策行为的 效力、健全村委会成员违反民主决策的民事赔偿制度、建立具体完备的村民会议 制度；完善民主监督机制的建立；扩大行政诉讼的受案范围等。  关键词：村民自治  村民自治权  法律保障 I 试论当代中国村民自治权的法律保障 Abstract Villager autonomous right is an important concept of villager autonomy, the process of villager autonomy can be promoted both in democratization and in law only if the exercise of the villager autonomous right is ensured. Currently, the researches of villager autonomy are mainly elaborated in the field of sociology and politics. As an institution of law, less attention has paid to the villager autonomy by the jurists. This study based on the view of law, and take villager autonomous right as a breakthrough, to systematically and comprehensively identify and analyze different legal issues in the exercise the villager autonomy, the author tries to provide legal suggestions and measures to solve the conflicts existed in reality, thus avoid the research flowed as an empty talk.
