论劣质食品侵权以及法律完善 内容提要： 食品安全问题关系国计民生，可就算其如此之重要，食品安全事故在生活中仍时常发生，从苏丹红鸭蛋到三聚氰胺奶粉及牛奶再到爆炸西瓜，地沟油，墨汁粉条，毒豇豆，假牛肉——短短几年时间食品安全问题却层出不穷，而且有愈演愈烈的趋势。对食品安全的整治可以说已到了刻不容缓的地步。虽然关于食品安全问题工作的开展一直是政府工作的重点，而且政府在食品安全监管与对不法行为的惩治上下足了力气，但对食品安全问题的顽固性仍不能根治。因此本文紧密结合我国食品安全现状，对食品安全问题产生的根源进行了剖析，并从中国目前食品制度方面的法律出发，针对食品安全事故侵权问题，为受害者维护自己的合法权益提出了相关法律救济机制以及建议，最后在此基础上提出了自己对食品安全法律制度的完善的看法以及相应对策。 关键词：劣质食品 侵权 法律完善 Poor food and theory of tort law perfect Abstract Food safety problem relationship beneficial to the peoples livelihood, even if its so important, food safety accidents in life are still often occur, from duck to melamine milk powder and milk to the explosion of watermelon, drainage oil, ink stick, poisonous cowpea, false beef -- just a few years, food safety problem is emerge in an endless stream, and there is growing trend. The food safety rectification can be said to have to brook no delay. Although the issues of food safety work has been the focus of government work, and government in the food safety supervision and punishment for illegal acts under the foot of the effort, but the problem of food safety is still no cure intractable. Therefore, combining with the current situation of food safety in China, the food safety problems are analyzed, and according to Chinas present food system in terms of the law of food safety accidents, in view of the infringement, as victims to safeguard their legitimate rights and interests and puts forward related legal remedy mechanism and proposal, finally based on this proposed oneself to food safety legal system of views and the corresponding countermeasures.
