- I - 中文摘要 婚姻自由是一个社会范畴的概念，必然随着社会的发展不断更新变化。由于 不同的历史时期人们对自由不同理解，婚姻自由也展现着社会定位与自然定位的 迥异面孔。其中，社会干预在于行使自由不得侵犯他人，不得危害公共利益；个 人意愿则侧重由心而发，不受干预。两种矛盾你消我涨，互相牵制，幸好人类社 会在发展，人和社会都在进步。婚姻自由在内部矛盾和外部矛盾的相互作用中螺 旋上升，体现着婚姻制度中最为重要的价值的进步和回归。 本文共分两大部分，第一部分为婚姻自由的历史范畴，主要从三个方面入手， 即从古代婚姻的不自由到近代婚姻自由的松动再现代婚姻自由的确立，本文详细 论述了各个不同的历史时期结婚、离婚和再婚自由的演变发展过程。第二部分为 婚姻自由是人格自由的标志，首先对婚姻自主权加以诠释，并进一步分析了婚姻 自由与婚姻自主权的关系；然后从三个方面对婚姻自由的相对性了阐述，即法律 的约束、义务和责任的约束以及道德的约束；最后对婚姻自由在现代社会中的法 律规制进行了分析，研究了对包办、买卖婚姻的否定，对借婚姻索取财物的摒弃， 对重婚的排斥，对家庭暴力，有配偶者与他人同居以及对同性恋的审视问题。 关键词：婚姻自由；历史范畴；人格自由；约束；法律规制- II - Abstract The freedom of marriage is a social category concept，inevitably unceasingly renews the change along with society’s development.
