摘 要 权力是指合法确认和改变人际关系或处理他人财产或人身的正当能力，权力制约是指权力的制衡与约束。权力的制约是我国乃至全世界法学界热衷于研究的主题之一。虽然各家的制约方法各有千秋，但制约权力的原因不外乎是权力的性质和使用者两大方面。西方各国大多以宪法的形式来明确规定权力结构和界限，各权力间相互独立又相互联系，形成制约。中国的宪政理论同样涉及权力制约，我们可以学习和借鉴西方的宝贵经验，建设社会主义法治政府，促进和完善中国权力制约体制。 在当今的中国，权力制约有着非同一般的意义。它不仅有助于解决贪污腐败的社会问题，还可以帮助权力的行使者提高和完善执政能力，帮助我们顺利建成法治社会。 本文第一章首先简单介绍权力的定义、来源等基本理论，接着第二章通过一个案例分析，论述权力制约的两大原因。第三章为本文的重点部分，主要是谈在中国社会的大背景下，权力制约在我国的发展变化及其与法治政府的相关问题。最后一章，则是讨论权力制约在当代中国的意义。 权力制约涉及的知识范围很广，笔者作为一个法律初学者从法律政治学和法律社会学的角度进行论述，运用历史分析法进行对比和研究。 关键词 权力, 权力制约, 宪政, 中国特色 Abstract Power is the ability to confirm and change the legitimate relationships or property of others or personal, power restriction refers to the balance and restriction of power.
