浅谈死刑及其在我国限制适用的思考 学生：卿又萍 班级：2003090202法学 指导教师 ：张艳 [摘要] 死刑是人类社会早已存在的现象。在人类历史的长河中，死刑经历了一个由兴起，泛滥与没落的生命过程。 在这个过程中，上下几千年，历史用其本身的属性为我们记录下死刑的生命轨迹，而本文正是用历史的方法从历史的角度来分析它的产生、发展、现状及其在我国适用中的思考。基于我国当前的实际状况，结合有关外国死刑制度和中国古代死刑制度，从人文精神、民众意愿、物质条件等方面阐述死刑在我国的存废利弊，最后提出一个由刑事政策、立法、司法相结合的死刑改革方案，即走一条由限制死刑适用向逐步废除死刑前进的道路。对死刑的历史研究有助于我们认识它的规律和预测它的未来，对我国死刑制度的改革具有现实意义。 关键词： 死刑 死刑存废 死刑的限制适用 The reflection on death penalty and strict control of it in our country [ Content summary ] The death penalty is a phenomenon that had been in existence for a long time. In human-being society, the death penalty experienced a period from emergence to thrift, and finally declination. Under this process, for thousands of years, the history recorded the process of development of the death penalty by its own way. Not only do this passage analyse the emergence and development of the death penalty, but slso ponder on its appliance in china with the historical method. Firstly, based on the current situations, this passage tells the difference between the death penalty system of china and foreign countries. secondly, this passage elaborates the advantages and disadvantages of the death penalty in three aspects, modern civilization, demotic wish and physical conditions. thirdly, this passage proposes a reformation project that china should develop from the period of limitation of deth penalty to the abolition of death penalty. There is no doubt that the reserch on the death penalty will advance the development of the reformation of the capital punishment. Keywords:The death penalty The existence and abolition of death penalty Strict Control of Death penalty 第1章 前言 1.1 研究的目的与意义 死刑这种最古老最严厉的刑罚方法在人类对其适用的过程中，认识不断深化。从其产生直到光明正大毋庸置疑的适用，历时数几千年之久。直至18世纪晚期，人类终于开始对它的存在意义提出质疑，尽管关于死刑存废的争论仍然在持续，但世界却已掀起废除死刑的运动潮流，死刑制度面临前所未有的冲击。本文正是立足于推动我国死刑制度的合理化改革以适应时代需求的目的，即积极限制死刑的适用、努力减少死刑的判决和执行、适时推动死刑朝废除的方向发展。着重研究死刑及其在我国限制适用的可行性、必要性和操作性，以求解决我国死刑制度目前存在的问题和对我国死刑制度的进一步改革提供参考。 1.2 国内外研究现状与问题
