天 津 财 经 大 学 本 科 毕 业 论 文 题目：我国城市房屋征收补偿制度的问题研究 院系名称：经济学院金融系 专业班级：房地产金融1001 （辅修法学1101） 学 号： 2010110699 姓 名： 王梦晴 指导教师： 田立军 副教授内容摘要 随着社会主义市场经济体制建立，城市改造幅度加大，势必引致了城市拆迁力度加强。近些年法律制度不断完善，历经三年两次意见稿的修改《征收条例》也在2009年出台，我国城市房屋征收补偿制度已基本确立并在逐步优化。但是实际操作中却存在大量的恶性事件，因拆迁引起的自焚、暴力等不断成为社会瞩目的焦点。由此可见，城市房屋征收制度依旧不完善，仍是目前我国政府及群众高度关注的重点。 本文先是对我国房屋补偿制度的含义介绍并对法律制度的演进进行简述，其次对涉及征收补偿制度中出现的三方主体地方政府、房地产开发商、被拆迁人在征收补偿过程中的地位与作用进行分析。再通过对目前征收补偿过程中征收程序与补偿范围分别出现的问题进行整理，从政府、开发商和现有的法律规定漏洞分析导致这些问题的成因，最后从公共利益的重新界定、政府合理定位、评估机制完善监督和优化土地补偿制度等几个方面有针对性的提出完善我国城市房屋补偿制度合理化的建议。 关键词 城市房屋；征收补偿；估价机制 Abstract With the establishment of the socialist market economic system, intensified urban renewal, the city is bound to lead to the demolition of efforts to strengthen.
