论如何制定装卸时间和滞期费条款对船东有利 [摘要] 2013年以来BDI指数徘徊在1000点上下,整个航运业的不景气已经成为了一个定局。在这么一个低迷的状态下,船东如何把控成本,就成了企业发展必须面对的课题。在把控成本这一方面不仅仅要降低船舶耗油,提高航速等等,还应该包括制定合同上。装卸时间和滞期费条款是非常重要的,这个课题的重要性在国际航运与外贸领域没有降低反而更加重要。在航运市场低迷的情况下,如果船东可以很好的制定好这个条款,对他的接下来的航次都占据着非常有利的地位。 本文从金康94的租约的条款出发,分析其中的装卸时间和滞期费条款,并结合案例来说明;最终得出船东如何制定装卸时间和滞期费条款来保证自己的利益。 [关键词] 滞期费 装卸时间 效益 金康94 A Dicussion about How to Make the Laytime and Demurrage Terms can Benefit Shipowners [Abstract] The BDI index hovered at about 2000 Since 2013,the depression of the whole shipping business has become an inevitable outcome. So the issue, the shipowners how to control the costs,is becoming a must confronting task for the development of the enterprises in such a depressed state. In the aspect of controlling the costs, it is not only refers to reduce the fuel consumption, increase the speed and so on, but also should reflect on the formulated contracts. The lay time and demurrage terms are very important, and the significance of this issue did not reduce but even more important in the field of international shipping and foreign trade. In the condition of the depressed shipping market, if shipowners can formulated the clauses very well, they will in a very advantageous position on their next voyages. This paper starts from the terms of the lease of GENCON 1994 it analysis the terms of the lay time and demurrage, and combined with the cases to illustrate the conclusion of how to develop the lay time and demurrage clause for shipowners to ensure their own interests.
