哈萨克族论文：哈萨克族婚姻习惯法和国家制定法的冲突与调适 【中文摘要】哈萨克族是传统的游牧民族,在哈萨克族长期历史发展的过程中,形成了具有浓厚草原游牧特色的习惯法文化,并对哈萨克族人民的生产生活具有深远的影响。其中,婚姻习惯法最具有代表性,它是哈萨克族人民历史文化、宗教信仰、思想观念的方面的综合体现。但是国家制定法的普遍适用性却和这种少数民族习惯法产生一定的矛盾与冲突,影响国家制定法在哈萨克族群众中的适用效力。本文从概括哈萨克族婚姻习惯法的内容及特点出发,分析国家制定法和哈萨克族婚姻习惯法的冲突的表现、性质及产生原因,最后从法律多元以及民族自治地方法律变通的角度,结合当前我国法律实践,阐述了关于哈萨克族婚姻习惯法和国家制定法的融合与调适的问题。文章共分四部分,第一章绪论系统地论述关于哈萨克族习惯法和国家制定法冲突的研究意义,另外,对于本文相关领域的研究成果进行了总结概括。第二章,从婚姻缔结、婚姻家庭、离婚三个方面介绍了哈萨克族婚姻传统习惯法的内容、特点及变迁。第三章,国家制定的婚姻法,其效力范围及于全国各地,难以顾及各个民族的实际情况。因此,作为一种地方性规则的哈萨克族婚姻习惯法与之产生冲突在所难免。本章从二者冲突的表现、原因及性质三点论述,剖析哈萨克族婚姻习惯法与国家制定法冲突的实质。第四章,作为少数民族习惯法一种的哈萨克族婚姻习惯法其实与国家制定法并不完全冲突,二者之间应该实现良性的互动,少数民族习惯法可以成为国家制定法的渊源和重要补充,而国家制定法也应该充分尊重和包容。本章主要论述哈萨克族婚姻习惯法和国家制定法的调适的现状以及二者调适的途径。最后是结语部分,哈萨克族婚姻习惯法是具有鲜明特色的少数民族习惯法,对于国家制定法来说,应该实现它们之间的相互融合而不是排斥,这样才能更好的实现国家法与习惯法的互动。 【英文摘要】Kazak is a long historical nomad, has formed a series of common laws cultural with luscious grassland life’s features. These common laws have been coming into a great influence on the people of Kazak. In which, the marriage common law is the most typical law. It embodies this influence from many fields such as the cultural of history, the faith of religion, the conformation of consciousness. However, it causes conflict with the universal applicability of the national law and weakens the force of the national law on Kazak.
