中国政法大学 本科生毕业论文 当今中国贪腐犯罪死刑存废研究 学 号：2012501096 专 业：法学 姓 名：闫申 学 院：刑事司法学院 指导老师：刘丽娜 完成时间: 2016-2-29 论文成绩：  摘要： 随着《刑法第九修正案》的颁布与实施，又有诸多罪名废除死刑，其中却不包括学者呼吁已久的贪腐犯罪。贪腐犯罪是否应当废除死刑一直饱受争议，本文笔者从刑罚的目的入手，以刑罚二元论为视角对贪腐犯罪进行分析，从预防的角度考察得出即使没有死刑，贪腐犯罪的刑罚依然具有严厉性，可以产生足够的威慑，而从报应的角度观察，将贪腐犯罪与公认的可以判处的死性犯罪的社会危害性进行比较，从而得出贪腐犯罪的危害性远低于那些公认的死刑犯罪，同时以中国签署的国际公约为标准，进行抽象性的考察，得出贪腐犯罪的社会危害性不应当适用死刑，根据“罪刑相适用原则”应当废除该罪名的死刑。同时废除死刑有利于国际合作反腐，有利于更好的落实民意。 关键词：贪腐犯罪 贪污罪 受贿罪 死刑 刑罚 预防与惩治腐败 引渡 Chinese Corruption Crime Abolition of Death Penalty Research at Present Abstract：With the promulgation of Criminal Law Amendment IX and the implementation of the abolition of the death penalty there are many charges, which do not include many scholars have long called on corruption crimes. The abolition of the death penalty for better international cooperation against corruption and better implementation of the public has a positive effect.
