Abstract From the new China since its establishment, the administrative laws legislating activities in the legislative field are through a change from weak to strong, few to more, and accounted for the leading position, it made a great contributions to the perfection of China law system. But some of these administrative laws lack of public participation in the process of draft to release. And the imperfect of public participation in administrative legislation made administrative legislating activities lack of those factors such as, scientific, democratic, universality effectiveness, and what public doubt about. Although the process of democracy and the rule of law is speeding up in China, there is no a specific mechanism process of public participation, and the ways for public to participate in administrative laws legislation are too traditional, and the administrative legislating institutions are failed to use modern technology to broaden the public participation way. Whats more, administrative laws legislating institutions still in a side of the only big status, and because of the public lack of legislation initiative rights, private part can not leading the activities of administrative laws legislating, the only thing they do is Cooperate with administrative legislative institutions. Once the administrative laws legislation institution dont disclose the purpose of legislating, the public will doubt and repel the administrative institution and the laws legislated by administrative institution, it will harm to management of administrative institutions.
