专利池中专利权滥用行为及其规制 摘要 所谓专利池,又称专利联营,指的是两个或两个以上的专利权人达成协议,相互间交叉许可或共同向第三方许可其专利的联营性组织,或者是指这种安排之下的专利集合体。 随着科技的迅速发展，在国外许多行业的专利池都已建立，专利池的发展及专利联合所发挥出的巨大作用,是科学技术发展的重大进步, 其功能是能够节省交易成本促进竞争，对相关产业的发展起到了积极的促进作用。然而专利权人利用所掌握的专利池的技术,滥用市场支配地位、价格歧视等专利行为又会造成专利权的扩张形成专利权滥用的倾向，这又严重阻碍了相关产业的发展,因此,辩证的认识专利池是十分重要的。专利池本身的积极作用和消极作用，关键在于是否存在权利滥用行为，能够有效地区分专利池中专利权的滥用行为并能采取行之有效的方法进行规制，专利池就会发挥其巨大积极作用，促进科学技术及行业的迅速发展。因此如何界定在专利池这种特定条件下的专利权滥用行为、以及如何对这种滥用行为进行规制是解决专利池问题的当务之急。 本文主要从四部分分析专利池中专利权的滥用行为及其规制方法：第一部分是关于专利池的基础概述。第二部分是对专利池中的专利权滥用行为问题的分析。第三部分是对专利池中专利权滥用问题的规制方法。第四部分综述专利池中专利权的滥用行为，分析我国专利池立法的现状及存在的问题，并提出相应的对策建议 [关键词]：专利池 专利权滥用 反垄断 The Abuse of Patent?Rights in?Patent?Pool?and Its Regulation Abstract Alleged patent pool, refers to two or more the patentee, mutual agreement to a third party cross licensing or common the patent pool license its sexual organization, or refers to the patent under this arrangement collection.
