Due to advances in digital technology, digital works in the transmission speed is not only growing, but also works to maintain the quality of the original. Since 2007, the video-sharing Web site has flourish in China like the springing , video content has become an important part of cultural consumption, with attendant video piracy is growing. In most cases, the video sharing site itself does not upload the video, the main problem is the existence of indirect infringement. The difficulty of recognizing the indirect infringement is to determine whether the Web “knows” users upload works which are not authorized-- that is whether to make to the appropriate duty of care. Since Chinas “Information Network Transmission Right Protection Ordinance” announced, the judge of the video sharing site knowingly has been the difficulty of judicial practice, courts in the video sharing sites for copyright infringement cases in which the duty of care standards are not uniform. Consideration for the balance of interests, this study focused on how to apply the duty of care standards.
