法治、非正式制度与市场经济秩序 [摘要] 文章通过阐述法治与市场经济秩序的契合、法治与非正式制度的关联、非正式制度与市场经济秩序的链接、制度实 施与制度变迁等内容，建议在深刻认识法治、非正式制度与市场经济秩序三者关系的基础上，处理好法治体系构建和完善中的 继承、移植和本土化创新的关系，注重法治实施；发挥政府和市场的作用，推进非正式制度变迁；注意制度实施和制度变迁中 法治与非正式制度的相容；在法治的框架内发挥政府的作用；在市场经济秩序的构建和完善中，分政府主导、市场主导和社会 主导等阶段推进法治建设。 [关键词] 法治；非正式制度；市场经济秩序；制度实施；制度变迁；路径依赖 Law-basedGovernance,InformalSystemandMarketEconomicOrder Abstract: This article expatiates the contents as following: relations between the law-based governance and the market economic order, the correlation between law-based governance and informal institution, linkage between informal institution and market economic order, system implementation and system adjustment. It suggests that based on the understanding of the relations among law- based governance, informal institution and market economic order, we have to handle well law-based governance system and perfect relations among inheritance, transplantation and localized innovation. We have to pay attention to the law-based governance implementation, give full play of the government and market, promote the informal institutional adjustment; pay attention to the system implementation and system change of the law-based governance and informal institution; give play of the government within the framework of the law-based governance. With government leading, market leading and society leading, we should promote the construction of the law- based governance orderly.
