受教育权纠纷解决途径完善论文
Abstract
Education is not only for the development of citizens, but drives the development of the
country. In modern society, the right to education is a basic right, which also is stated in
clause 46 of the Chinese Constitution. With the progress of the society and the development
of the country, education is increasingly becoming the significant fact of individual
development. So educators gained more attention from the society and disputes among the
citizens concerning the right of education increased gradually. However, because of the
theoretical arguments and the implementation of the law has been less than precise, these
disputes have not been solved efficiently. In order to fully guarantee the citizens’ right to
education, this essay will start with the essence of the right to education, and explicate the
conception and features of the right to education. From this basis, it will categorize the
disputes of the right to education. Secondly, it will research some legal texts as some certain
cases, and analyze the problems in the disputes solving. Lastly, it will introspect and reform
the present theories, and put forward some measures to improve the disputes.
Apart from the preface , this article altogether is divided into five parts.
Part one starts with the essence of the right to education, and it explicates the conception
and features of it on the basis of the conclusion on the essence and contents of the right to
education. Used by the education opportunities right disputes, the education condition right
disputes, the dividing method of education success of a dispute, to facilitate the educational
disputes in judicial practice of textual research.
