大学生创新训练项目 研究报告 项目名称： 劳务派遣人员劳动关系状况研究——以我校图书管理人员为例 项目类型： 一般项目 项目年度： 二零一四年 项目负责人： 苗瑞凤（学号：32012050016） 负责人院（系）： 劳动经济学院 专业（方向）： 人力资源管理专业 项目组成员： 郭瑶、刘帆、刘赟、宋丽娜 指导教师： 詹婧 副教授 教务处 制 二〇一五年 摘要 随着社会和劳动力市场的不断发展，目前劳务派遣在国内应用领域越来越广泛，派遣规模也越来越大，越来越多的劳务派遣人员成为企业用工的重要来源，有93％的大型企业(500人以上规模)不同程度地接受着劳务派遣服务。然而，在这之中存在着很多法律及社会问题亟待解决，比如同工同酬的认定，劳务合同和劳动合同的法律效力上的区别，如发生工伤，哪方承担赔偿责任，以及年轻的劳务派遣员工对自身的看法和职业规划等。而我们作为人力资源管理专业的学生，日后很有可能就会面对这些问题，因此，我项目组成员欲研究我校图书馆管理人员中的劳务派遣人员的劳动关系和职业发展情况，并对其进行综合分析，从各个方面提出建议，并提高自身认识。 本文以首都经济贸易大学图书馆，管理人员中的劳务派遣人员为例，通过对该群体进行实证调查，利用访谈法的方式，分析首都经济贸易大学图书馆劳务派遣人员的劳动关系和职业发展情况，探究其工作状态和职业发展前景。最终结合该工作群体的特点对劳务派遣单位、用工单位，以及员工提出管理和职业规划建议。 关键词：劳务派遣人员，劳动关系，职业规划 Abstract With the continuous development of society and the Labour market, the current labor dispatching is finding wider and wider application fields at home, sending scale is becoming more and more big, more and more become the important source of enterprise labor dispatching personnel, 93% of the large enterprise scale (more than 500 people) in different degrees under the labor dispatch service. However, among which there are many legal and social problems to be solved, such as the cognizance of equal pay for equal work, labor contract and labor contract law on the distinction, if produce inductrial injury, which party shall bear the liability for compensation, and young labor dispatching employee perceptions of their own, and career planning, etc. And we as a student majoring in Human Resource Management, is likely will face these problems in the future, therefore, my team members to study the university library management of labor dispatching personnel and professional development of labor relations, and carries on the comprehensive analysis of Suggestions from all aspects, and improve their understanding.
