法人单位、产业活动单位及个体经营户划分规定（Provisions for the division of legal entities, industrial activities units and self-employed households） Provisions for the division of legal entities, industrial activities units and self-employed households Article 1 These Provisions are formulated in accordance with the relevant laws and regulations of the state in order to implement the measures for the first national economic census, and to scientifically define legal entity units, industrial activities units and self-employed households. Article second of the provisions of the legal entity, refers to the following conditions of the unit: (1) in accordance with the law, having its own name, organizational structure and place, and being able to bear civil liability independently; (two) independently possessing and using (or authorizing the use of) assets, assuming liabilities, and having the right to enter into contracts with other units; (three) independent accounting, able to prepare balance sheet. A legal entity consists of an enterprise legal person, a public institution, a legal person, a legal entity, a social organization, a legal person and other legal persons. Third enterprise legal person which is based on the Peoples Republic of China corporate registration regulations, Peoples Republic of China company registration regulations, registered by the industrial and commercial administrative organs, receive a business license, the enterprise has obtained the qualification of legal person. Enterprise legal persons include: (I) company; (two) non corporate legal persons. Fourth legal institutions, is approved by the agency and staffing administration department of the State Council national institution registration department registration or filing; or approval, by the local institutions at or above the county level administrative departments of the local institutions at or above the county level administrative departments of registration registration or filing, receive the certificate
