土地市场构建国家民事主体制度思索 　 摘 要：法律规定国务院代表国家行使土地所有权，但国务院不能实际履行代表行为，又没有转委托于其他主体而致使所有权行使主体缺位。土地行政监管部门自封为土地所有权的出让人，其结果不但是主体错位，而且为地方政府通过公权力主体“挟持”民事主体而形成政府间的竞争提供了法律依据。追求政绩工程的区域竞争是政府垄断建设用地供应市场的动力，由地方政府形成的进入障碍是城乡建设用地市场二元结构的制度性原因。统一城乡建设用地市场的关键是国家民事主体的地位独立和平等。 关键词：土地市场；国家民事主体；物权 The thinking of land market constructing system of countries’ main body of civial Abstract: according to the law,State Department depute the country and execute the property of land, but State Department cannot fulfil the deputation behaviour practically, and cannot re-commission the responsibility to another part, so the mainbody of ownership execution is absent. Land administration authority self-regulate itself as a bargainor of the land ownership. The result is not only the dislocation of the main body, but also provide a legal basis for the competition between governments which is engendered by local government coercing the main body of civial via main body of public right. Pursuit of political achievements of the regional competition is the power of monopolising the construction land for supplying the market. Entering barriers which is engendered by the local government is the reason of the dual structure market system of the urban and rural construction land. The main point of unifying urban and rural land construction land is the independence and equality of the main body of civial in the country. Key word: land market; countries? main body of civial; property 十七届三中全会提出了“建立城乡统一的建设用地市场”制度。设置这一制度的关键是参与市场竞争的主体地位平等，国家土地所有权者与集体土地所有权者在市场交易时都属于平等的民事主体，否则不可能统一。因此，必须理性思考如何从制度上让国家民事主体独立。 一、现行国有土地出让制度中的民事主体缺位 国家具有双重身份是客观存在的事实。国家普遍地属于政治主体，对外是主权主体，对内是行政强制主体；还是全国人民共同财产的所有权主体，凡是全民所有就是国家所有。认可这个事实，便于清晰地划定国家双重职能的界限，防止主体行事时交叉利用其身份。但是，现行国家所有权制度中的国家所有权主体相当模糊，尤其是在国家土地所有权的归属和利用方面，更是所有权主体被政治主体所淹没。 《土地管理法》第2条规定：“全民所有，即国家所有土地的所有权由国务院代表国家行使”。该规定明确了国务院不享有所有权而是代表行使所有权。一般情况下，根据主体代表行使民事物权的内容，可以推定代表行使的主体属于民事主体。但是，国务院主要是国家的行政决策机关，如果要认定为民事主体，则不能依靠简单推定，还必须有明确规定国家民事主体独立的法律依据。可是，从土地所有权享有主体过度到代表行使主体，并没有明确两者的民事主体身份。 而且，国务院本身又是虚拟的人格
