我国城市房屋拆迁制度的反思及完善 ——基于利益机制视角的分析 张 刚 （中国人民大学公共管理学院 北京100872） 摘要：随着城市化进程加快和城市建设的纵深推进，以城市改造、重建和扩展为主体内容的城市房屋拆迁规模日益扩大、速率也日渐加快。我国的房屋拆迁制度经历过不同时期的发展阶段，但仍然存在不完善的地方，由城市房屋拆迁引发的群体性、恶性事件以及由此凸现的利益矛盾和利益冲突，特别是被拆迁人与开发商和政府之间的冲突已成为社会各界关注的热点和焦点。本文结合国内外研究现状，从我国房屋拆迁制度的现状分析出发，并运用博弈论从房屋拆迁过程中不同主体的利益博弈分析来反思现行房屋拆迁制度存在的问题，最后从利益机制的视角提出改革和完善我国房屋拆迁制度的建议，对现行房屋拆迁制度的顺利实行和解决房屋拆迁过程中的矛盾纠纷有很大的现实意义。 关键词：城市房屋拆迁；利益博弈；利益机制 Chinas Urban Housing Demolition Systems Reflecting and Improvement ——Based on the Mechanism of Analysis from the Perspective of Benefits Zhang, Gang （School of Public Administration, Renmin University of China, Beijing100872,ChinaAbstract: With urbanization and deepened urban construction, urban renovation, reconstruction and expansion as the main content of the increasing size of urban house demolition, the rate has gradually accelerated. Our system experienced a house demolition in different periods of development, but there are still imperfections. Caused by the urban mass housing demolition, highlights the serious incidents and the resulting conflicts of interest and conflicts of interest, especially in demolition and development the conflict between business and government sectors of the community has become the focus of attention and focus. The paper first analysis the system of housing demolition of the current situation and than to understand the institutional development of housing demolition process and house demolition of the existing model, using game theory different from the main house demolition process to reflect the interests of the game analysis system of the present existence of house demolition issues and mechanisms from the perspective of the interests to reform and improve the proposed system of house demolition, the demolition of the existing housing system for the smooth implementation of the process of house demolition and resolve contradictions and disputes have great practical significance.
