Quest Software Beijing Company Limited Quest 虹天软件(北京)有限公司 End User License Agreement 终端用户授权协议 INTRODUCTION 介绍 This “Agreement” is made between Quest Software Beijing Company Limited with its principal place of business located at Room 501, Building C1, Oriental Plaza, 1 Dong Chang’an Jie, Beijing (“Quest”), and you, the customer, (hereafter referred to as “Licensee”). For the purpose of this Agreement, “Software” shall be defined as: (i) the machine-readable object code version of the Quest software provided under this Agreement; (ii) the published user manuals and documentation that Quest makes generally available for such software (the “Documentation”); (iii) any corrections, enhancements, and upgrades to the software that Quest may make available pursuant to Section 6 below, and (iv) all copies of the foregoing. 本协议由Quest 虹天软件(北京)有限公司、其主要营业地址为北京市东城区东长安街1 号东方广场C1 办 公楼501 室（“Quest”）和阁下、即本公司之客户（下称“被授权方”）共同签署。为本协议之目的， “软件”应定义为：(i) 在本协议项下提供的可机器识读的目标代码版本的Quest 软件；(ii) Quest 就该软 件而公开发布的用户手册和文档 （“文档”）；(iii) 对于Quest 根据下面第6 条而可能提供的软件的任何 修订、改进和升级；以及 (iv) 上述一切之副本。 1. LICENSE. Subject to the terms and conditions of this Agreement, and in consideration for the license fees paid by Licensee, Quest hereby grants to Licensee, and Licensee accepts from Quest, a perpetual, non-exclusive, non-transferable and non-sublicensable right to use the Software. This license consists of the right for Licensee to install, use, access, run, or otherwise interact with the Software within the scope of license granted, in and for Licensee’s own internal business operations, and in accordance with the related Documentation.
