摘 要 集体公益林因其在集体林中所占的较大比重，加之其具有的公益属性，使集体林 权制度改革更具特殊性。本文运用马克思产权理论以通辽市的集体公益林权改革为研 究方向，取得的主要成果与结论如下： (1)分析了通辽市集体公益林权改革存在的主要问题，即改革实施主导者自身 的阻力、改革实施中产权自身的制约、改革实施进程中反映的问题以及改革实施结果 反映的问题等； (2)剖析了集体公益林权改革的问题的成因，即所有制与所有权混淆，排斥林 农拥有林地经营权的改革；以法权表现替代经济关系；产权权项界定不清晰，致使林 农产权难以确认；索取权或收益权分配不完善，致使林农利益没有保障；未能形成有 效的法权表现；上层建筑建设不足； (3)提出了深化推进通辽市集体公益林权改革的对策建议，其一，坚持以马克 思产权理论为指导，深入改革所有制、经济关系而非所有权和产权；其二，逐步推动 集体公益林规模化经营、规范集体公益林林地和林木流转、建立公共财政制度和政策 性集体公益林保险制度及以合作社为核心建设社会化服务体系推动产业化经营和严 格公益林森林生态效益补偿基金制度，实现外部性内部化。 关键词：马克思产权理论；林权制度改革；集体公益林；通辽市 Abstract Thereforrnofthe collectivewelfareforestsiSmore becauseofits public particularity the inthecollectiveforestand itsattributeof welfare．Withthe largerproportion public research directionofcollectivewelfareforests formed reform,itresults public ownership andconclusionasfollowbasedonMarxist theoryofpropertyrights． thesis themain ofcollectivewelfareforest (1)Theanalysed existingproblems public reforlTlin are the resistancefromreforrner ownership Tongliaocity．Whichincluding the from leadingone，restriction propertyrightspushingthrough in the ofreformandinthereform problems process results，etc． thecauseofthe ofthecollectivewelfareforest (2)Itanalysed problem public retorm,that and the ownership 1S，conf
