滇西南基层司法人民调解工作现状及发展设想 作者 李仕江 导师 杨莉红 摘要：文章从滇西南的民族风俗、民情出发，结合基层司法工作，述写少数民族聚居、杂居地区基层司法人民调解工作的开展现状和发展趋势、发展设想。文章首先阐述滇西南基层司法人民调解工作开展的社会背景，解读《中华人民共和国人民调解法》以及其在少数民族地区的应用。主要探索人民调解的发展趋势，从人民调解组织、专职人民调解员制度、调解方法及语言、在线纠纷解决（ODR）机制、民族风俗与现行法律冲突的协调、救济途径等探究滇西南基层司法的人民调解工作发展趋势、设想。 Abstract: The article from Yunnan national custom, the public sentiment embarks, the binding case judicature work, states writes the national minority to live together, to live together with different nationalities the local basic unit judicature people to mediate the work the development present situation and the trend of development, the development tentative plan. Mainly explores the trend of development which the people mediate, mediates the organization, the professional people mediator system, the mediation method and the language, the Online Dispute Resolution (ODR), the national custom and the present legal conflict coordination, the relief way and so on inquired into southwest Yunnan the basic unit judicature people mediate the work trend of development, the tentative plan. 关键词：人民调解 专门调解委员会 专职调解员 调解趋势 发展设想 Key words: Peoples mediation Specially redressing committee Professional mediator Mediation tendency Development tentative plan 在这少数民族聚居、大杂居的滇西南，有独特而耐人寻味的民族风俗、家族习俗，有让人费解的民族禁忌、民族信仰，有神秘的宗教教规、宗教惯例。这些民族文化和现行法律存在许多冲突，在实现创新型社会管理的过程中，人民调解工作有着不可替代的解决纠纷优势，能巧妙的化解社会纠纷又能维护民族团结友善，有效减少社会管理成本、预防群体性事件。 滇西南社会环境现状 滇西南少数民族聚居区社会环境 滇西南是指云南省西南地区，包括普洱（原思茅）、西双版纳、临沧三州市，是少数民族小聚居、大杂居的州市，地处无量山、哀牢山，崎岖复杂的地形把滇西南地区分隔成了众多相互隔绝、互不连通、封闭性极强的地域单元，导致区内民族分化易、融合同化难，使众多民族在这里得以安居乐业。主要少数民族有彝族、傣族、哈尼族、拉祜族、景颇族、佤族、布朗族、纳西族、基诺族、瑶族、苗族、回族、壮族等，少数民族人口约占总人口的2/3。 滇西南地区少数民族聚居区域分布较明显。哈尼族、彝族和拉枯族等少数民族主要分布在普洱市，普洱市位于中国云南省西南部，辖一区九县，其中九个县都属于少数民族自治县。总面积4.5万平方公里，东南与老挝、越南接壤，西南与缅甸比邻，国境线长达625公里。普洱市少数
