毕业设计（论文）说明书 学 院 管理学院 专 业 工程管理 年 级 2002级 姓 名 江晨 指导教师 李长燕 2007年6月15日 摘 要 从80年代至今，招标投标的采购方式在中国工程建设等多个领域得到了普及和发展。然而，只有短短几十年历史的中国招标投标制度仍存在许多问题，如不正当交易和腐败问题较为严重，一些业主不愿招标或规避招标等等。造成上述问题的根源之一就是我国招标投标相关法律法规尚不完善。针对上述情况，本文将以《中华人民共和国招标投标法》（以下简称《招标投标法》）作为主要研究对象，通过比较对比的研究方式，研究《招标投标法》的不足之处与改进空间。具体来说，选择了世行的相关规定《国际复兴开发银行贷款和国际开发协会信贷采购指南》（以下简称《指南》）作为比较对象，从招标公告、资格审查制度、低于成本的报价等八方面与《招标投标法》进行对比分析，通过它们的异同点，分析《指南》中值得借鉴之处，得出我国招标投标相关法律法规在监督管理方面、无标底招标等方面仍存在进一步改进的空间。 关键词：招标投标；国际惯例；采购 ABSTRACT Since 1980s, tendering as a procurement manner has been developed in the construction and other fields in China. However, the tendering system in China, which had a short history of several decades, is still facing many problems. For example, the problems of improper trading and corruption are serious, some employers do not wish to tendering or avoid tendering, and so on. Contributing to this problem, one of the root causes is that Chinas tendering laws and regulations is not yet perfect. View of the above circumstances, the thesis takes “Law of the Peoples Republic of China on Tenders and Bids” (hereafter referred to as “Law of Tendering”) as the main subject. By the method of comparison, it will be researched in the insufficiency and improvement room. Specifically, “Guidelines: Procurement under IBRD Loans and IDA Credits” (hereafter referred to “Guide”) will be chosen as a target, from the tender notice, the qualification system, price below cost and other five aspects to contrast with the “Law of Tendering”. Through their similarities and differences, the thesis analyses the advantages of the “Guide”. The conclusion of this thesis is, supervision and management, no-bid tender still exist room for further improvement in bidding laws and regulations.
