摘 要
上世纪二十年代，追续权制度在法国诞生，是艺术家从其艺术作
品转售价款中分享一定比例利益的权利，该制度旨在平衡艺术家与艺
术作品投资商严重不平衡的利益差。2012年10月国家版权局公布了
《中华人民共和国著作权法》修改草案第三稿，当年12月该修订草
案提交国务院法制办，该草案第十二条被解读为对追续权的规定，这
也预示着我国建立追续权制度已是大势所趋。该制度自诞生以来，有
关其合理性
