中国人民大学2009年暑期课程 中国法律系列讲座 中国法律制度概论部分 课程简介 中国法律制度概论课程将描述一个非常简单的古代和当代中国法律制度的图画。它将集中在古代中国法律文化不同于西方法律文化的一系列特征上，包括一元化与多元化，差别对待与平等对待，和谐与诉讼，特别注意中国法的框架，在立法、法律实施、法律职业和法学教育中广泛存在的正式法与非正式法的二元结构。自从1980年代以来，中国一直在向着法制化和正规化的方向发展，越来越多的法律，越来越多的诉讼，越来越多的法律工作者和越来越多的法学院。非正式的法律制度如何？随着正式法律制度变得越来越强大是否非正式的法律制度的作用注定要减弱？本课程的主要内容将集中在中国社会正式与非正式法律制度之间的关系上。 Course Description Introduction to Chinese Law In this course I will draw a very simple and general picture about Chinese law, both ancient and contemporary. I will focus on the characteristics of ancient Chinese legal culture which differ from western law, that is, monistic law vs. plural law, differentiated law vs. equal law, harmony vs. lawsuit; focussing especially on the framework of Chinese law, formal and informal law in different fields: law-making, law-enforcing, legal profession and legal education. Since the 1980s China has moved toward legalization and formalization, more laws, more litigation, more lawyers and more law schools. How about informal law? Is the role of informal law doomed to decrease in society while formal law becomes stronger and stronger along with economic modernization?
