行 精 類 行 年年 行 立律 參理 李 理 年 【計畫中文摘要 】 智慧權是法律保護人類智慧創作成果之重要權利 可， 將之使用於總稱所有智 慧權之各種權利 ，例如著作權 、商標權 、發明 、新型及新式樣專利權 、積體電路 布局權、植物品種及種苗、營業秘密等 。其權利內容包括智慧財產權及智慧人格 權 ，智慧財產權向來較受重視 ，但智慧人格權之用語及內容 ，可能會有不同之看 法存在。目前著作人格權在國際著作權伯恩公約及多數內國著作權法所承認 ，其 包括公開發表權 、姓名表示權及不當變更禁止權（過去稱為 「同一性保持權 」）。 又專利法及積體電路布局保護法中 ，也承認發明人及創作人之姓名表示權 ，但創 作人是否享有 公開發表權及不當變更禁止權等其他人格權 則在法律上較少被注， 意 。至於所謂智慧人格權之概括稱呼，也不多見 。因此 ，本計畫擬建構「智慧人 格權 」概念 ，並擬全面探討個別智慧權中有何種權利包含人格權，最後將試提出 立法及學理上基本原則之建議 ，以利應用及研究參考。 【計畫英文摘要 】 “Intellectual Property Right”plays an important role in the legal protection of the human intellectual creation. It includes copyright, trademarks, invention, utility models, industrial designs, layout-designs (topographies) of integrated circuits, plant patents or other rights, trade secret. Its content includes intellectual property and moral rights. This project explores a new concept, “intellectual moral rights”. The moral rights are recognized under the Berne Convention and the copyright law in the foreign countries. The copyright law in Taiwan regulates moral rights, such as the right to be identified as the author of a work, the “integrity right”. In the Patent Law there is only the right to be identified as the inventor or creator. We will rethink the concept of moral rights in the intellectual property system. Therefore this research will try to apply “moral rights”to the intellectual rights in the comprehensive meaning in order to revise the related laws and regulations as well as to suggest basic principles resolve some issues in practice and theory.
