明代热审制度研究Research on the system of hot trial in the Ming Dynasty

摘 要
热审是明清时期的一项恤刑制度。热审源于《礼记·月令》：“孟
夏之月，断薄刑，决小罪，出轻系”的司法思想。明代之前，夏季恤刑
时常举行，但是还没有形成制度。洪武年间多次实行恤刑，永乐二年
夏季，徒流以下的轻罪人犯，命其出狱等候判决或者直接释放，此后
作为定例实行。成化时，热审有定重罪矜疑、轻罪减等、枷号释放的
差别。嘉靖时，决定每年举行一次热审。热审先在北京，后推行到南京
和其它省份。热审每年小满后开始，历时两个月，六月底截止。热审作
为一项特别的司法制度，每年要奏请皇帝下旨方可进行，重要案件的
处理结果要奏请皇帝批准。
明代热审制度的形成和发展是个动态的过程，本文第一章对明代
热审制度进行梳理，分为热审制度的形成、热审制度的完善、热审制
度的衰落和热审制度的修复，力图展现这一动态过程。
第二章探讨明代热审制度的程序，包括热审的机构和官员、南京
热审和地方热审等。
第三章主要探讨明代实行热审的原因和背景，并通过具体的案例
反映明代热审制度的实行情况，阐述热审制度在明代政治、司法和社
会中的作用。
