DO I :10.16290/.cnki .1674 -5205.2002.02.005 　法 律 科 学 　　　　　　　　　　　　　　　2002 年　第2 期 (总第117 期)　 李晓龙 (厦门大学法律系, 福建厦门361005) [　] 　不纯正不作为犯可罚性的关键在于等价性问题, 也即不阻止构成要件结果 的发生与 于积极作为引起结果在何等条件下等价值决定着能否对不纯正不作为犯进行处 罚以及如何处罚。等价性的目的和实质就在于通过对客观上的作为行为和不作为行为在规 范上的等价值来限制对不纯正不作为犯的处罚范围。等价性的媒介是作为义务, 所以等价 性要求就是通过对作为义务层级程度和违反程度的限定来实现作为和不作为的等价值。 [] 　作为;不作为;等价性;作为义务 Abstract:This ar ticle discusses equal-value in off ense of non-typical omissio n.T he point of punishment to o ff ense of non-typical omission refers to that in w hat term s the act not prevent- ing consequences in important co nstructive co nditions to occur and consequences due to active act are of equal v alue, w hich determines w ether to punish offense of non-typical omission and how to punish.The purpose and essence of the equal-value is to confine the scope of punishment to of- f ense of no n-typical o mission by the equal-value of ob ectiv e act and omission in normalization. T he medium of equal-v alue is the duty of act.Co nsequently, the requirement of equal-value is to realize the equal-value of act and omissio n by conf ining the deg ree of the duty of act in arrange- ment and violation.
