浅析重大责任事故罪的罪过形式 ［摘要］ 在生产和作用中，重大责任事故的发生是在实践中比较常见的，可能有的事故造成了比较严重的危害后果，而有的事故却引发了比较严重的危害后果。随着一些造成了比较严重的重大责任事故发生后，安全生产、安全作业已经逐渐开始引起国家、社会以及人民群众的广泛关注，关于重大责任事故罪的这一课题的理论研究也引起了法学研究学者的重视，特别是重大责任事故罪的罪过形式的问题，由于我国《刑法》中并没有做出明确的规定，很多学者提出了具有一定代表性的理论观点。 一般而言，重大责任事故罪都会造成相对比较严重的危害后果，可能会造成较大的人身或者财产的损失，通过刑事立法的方式，确立重大责任事故罪就是为了通过刑事处罚的手段，提高行为人从事生产、作业的警惕性，保障生产、作业的安全性，在一定程度上减少重大责任事故的发生，保障人们的生命财产安全。但是由于我国《刑法》及相关的司法解释，对于重大责任事故罪的构成要件规定得不是十分明确，在刑事审判的实践中，可能出现轻罪重判或者重罪轻判的情形，这都是违反我国行为罪责刑相适应的基本原则的，也是有悖于我国刑事立法的立法本意的，因此，笔者以重大责任事故罪的罪过形式作为研究的课题，通过文献收集的方法和比较分析法，在充分分析我国的现行的重大责任事故罪的立法状况的基础上，借鉴外国的相关经验，深刻剖析我国《刑法》中规定的重大责任事故罪的罪过形式。也希望相关立法和司法部门可以根据我国的实际国情，尽快出台相关的立法解释和司法解释，明确规定重大责任事故罪的罪过形式，从而完善我国的重大责任事故罪的犯罪构成。 ［小清新］ 重大责任事故罪 罪过形式 理论探讨 According To The Important Responsibility Of The Accident Crime Sin Form [Abstract] In the production and function, the big responsibility the accident was in practice more common, may have resulted in serious harmful consequences, and some accident is caused serious damage.
