ABSTRACTEcologicalcompensationinriverbasinswillgivegreatbenefittotheeconomicdevelopmentandsocialprogressoftheentireriverbasins,theecologicalenvironmentprotectionandrestorationoftheriverbasins,thus,achievingtheultimatesustainabledevelopmentofit.Thestudyonecologicalcompensationinriverbasinsabroadhavegainedexperienceatboththeoreticallevelandpracticallevel,domesticscholarshavealsoconducteddeepresearchintothedefinitionofecologicalcompensation,subjectofthecompensation,thecompensationstandard,objectofthecompensation,themethodforcompensation,aswellasthemanagementsystemandsoon,andthentheyalsoformedrelevantviewpoints.Thispaperarguesthatinordertounderstandtheconceptofecologicalcompensationinriverbasins,it?snecessarytounderstandtheconceptionofecologicalcompensationinriverbasins,thedefinitionofriverbasins,ecologicalandcompensationrespectively.Andonthisbasis,ecologicalcompensationinriverbasinsshouldberedefinedcombiningwiththeuniquefunctionandvaluesoflaw.Ecologicalcompensationinriverbasinsis,inordertorealizesocialequityandjustice,guidedbythebeneficiariesofwatershedecosystemservicesorthegovernmentinthewayofthebasinsystemrestoring,maintaining,torepairitself,eventoimprove,maintainorenhancewaterecologicalservicefunctiontosacrificepeopleforavarietyofformsofeconomicandnon-economiccompensation.Thefirstpartofthisarticlestudiestheconcept,characteristicsandpropertiesofriverbasinecologicalcompensation,emphasizingthatriverbasinecologicalcompensationlegalrelationshiphasthreeproperties,whichareeconomiclegalact,theadministrativelegalactandthecivillegalact.Ecologicalcompensationinriverbasinsmainlyreferstonationaleconomiclawbehaviorofpublicpolicy,themainwayisfiscaltransferpayment.Riverbasinecologicalcompensationofadministrativelegalactreferstoenvironmentaladministrativecontractsignedbythestateorgovernmentwithenvironmentalprotectioncounterparts.Agreementsignedecologicalcompensationinriverbasinsincivillegalactisprivatelyforcompensationbymeansofthemarket,suchasthespontaneousorganizationofmarkettransa
