摘要婚姻是一种严肃的、以两性关系为基础的社会关系,它包含着承诺和责任。调整夫妻关系的配偶权不仅关系到夫妻双方的利益、家庭中其他成员的利益，而且关系着全社会的利益。近几年，随着改革开放的不断深入,我国在经济体制发生深刻变化的同时,重婚、姘居、包二奶等第三者插足现象也是层出不穷，此起彼伏，导致配偶合法权益一方被侵犯，对家庭和社会的和谐造成了严重的影响。有人认为，第三者插足的现象属于伦理范畴，应当有道德来调整，并辅以社会舆论来规制。然而，道德规范的柔弱、社会舆论的乏力，也使得法律的规制和完善势在必行。因此，建立以侵害配偶权为基础的第三者责任，并对其行为进行法律规制，以维护平等、和睦、文明的婚姻家庭关系，也是大势所趋。现代法学专家们的通说也认为，法律应给予婚姻关系权力化保护。当配偶权遭遇第三者的恶意侵犯时，法律应对合法婚姻中的弱势一方提供救济，以保障婚姻家庭和社会的稳定与发展。目前，我国新的《婚姻法》虽然早已颁布并生效，并出台了三个司法解释，但是针对配偶权及其保护的内容过于简单，对受侵害的配偶权的法律救济制度还未系统形成，不利于维护其权益。基于这种现象，本文以积极负责的态度对第三者责任进行深入的研究，使第三者侵权的责任问题能得到社会各界的关注和重视，也希望能为配偶权的保护提供一些法律上的帮助。关键词:配偶权第三者侵权第三者责任IAbstractAbstractMarriage,basedonthesexualrelationship,isaseriouskindofsocialrelationandcontainscommitmentandresponsibilitiesmeanwhile.Toadjustthespouserightisnotonlyrelatedtotheinterestsofbothhusbandandwife,butalsorelatedtotheinterestsoftheotherfamilymembers.Also,it’sinvolvedtheinterestsofthewholesociety.Inrecentyears,withthefurtherreformandopening-up,China’seconomicsystemhasundergoneprofoundchanges,atthesametime,somephenomenonaboutathirdpartysuchasbigamy,cohabitationareemerging,whichcausethatthelegitimaterightsandinterestsareviolated,andleadtotheseriousinfectiononthefamilyandsociety.It’sthoughtthatthethirdpartyinthemarriagebelongstotheethicalcategory,andtheproblemshouldbeadjustedbymoralityandregulatedbythepublicopinion.However,impotentmoralityandpublicopinionurgethatit’snecessarytomakeandimprovethelaw.Therefore,itwillbethegeneraltrendtoestablishthethirdpartyresponsibilitybasedonviolatingthespouserights,andtoregulatethebehaviorssoastomaintainanequal,harmoniousandcivilizedmarriageandfamilyrelationship.Modernlawexpertsthinklawsshouldprotecttherightsinmarriagetoo.Also,lawsshouldgiveremedytothevulnerablesideinthelegalmarriagesoastoguaranteethesteadinessanddevelopmentofmarriageandsocietywhenspouserightisviolatedmaliciouslybythethirdparty.AlthoughChina’snewmarriagelawhasbeenproclaimedandcomeinforce,and3judicialinterpretationshavebeenissued,thecontentofprotectiononthespouserightsisexcessivelysimpleandlegalremedysys
