RESEARCHONTHEIMPROVEMENTOFTHESUMMONBYFORCESYSTEMINCIVILLITIGATIONABSTRACTThesummonbyforcesystemincivillitigationisoneofthecivilactioninthecivilenforcementmeasures,however,insomeoftheleadingpracticesinthetrialofthesystem，becauseofitsinstitutionalflaws，itsproperroleandthepurposeofcivillitigationcan’talwaysbeachieved.Basedonalegalcase,thispaperpointsoutthatinpractice,includingsomepartieswhoentrustedlegalrepresentatives,theplaintiffandtheneedforjointactioninthepartofthepartiesandothersubjectsarealsonecessarytoappearincourt.becauseofitsunjustifiedrefusalcourt,litigationinterruptionisresulted.regardlessofthedismissalorinabsentia,areunabletoresolvethedisputesuccessfully.Inthispaper,startfromthestatusofthesummonbyforcesystem,Iexameditspracticalityandmaneuverability,andproposedsomedefect.Thenbyreferringtosomedomesticandforeignscientificandrationalapproach,combinedwithourbasicfacts,putforwardmeasurestosolvetheseproblems,.atlast,analysisthatthesemethodswerelegal.Inall,thispaperweredividedintofiveparts,eachpartofthemaincontentsare:Theintroductionisajudicialpractice.Thecaseofthesituationreflectsaconflictbetweentherealityandthelegalsystem.Forcingdefendantappearincourtcannotresolveallissuesinacivilaction.What’smore,thevalueofthesystemdidnottobefullyrealized.Thus,Ithinkaboutappropriatebodywhocanbeusedthesummonbyforcesystemincivillitigation.BasedontheprovisionsoftheCivilProcedureLaw,thefirstchapteranalyzesthedefectofthesummonbyforcesystem.Applicablesubjectsonlyincludethemainaccusedandcertainlegalrepresentatives,thescopeistoonarrow,settingthesecondsubpoenaasaprecondition,isalsounreasonable.Thesecondchapterpresentssomerecommendationsforexpandingtheobjectsofthesummonbyforcesystemappliesto.First,thesummonbyforcesystemshouldalsoapplytopartofthepartieswhohaveentrustlegalrepresentatives.Second,inthejointaction,somepartieswhodonotappearincourtwithoutjustifiablereasonsshouldalsoapplytothesummonbyforcesystem.Third,thesummonbyforcesystemshouldalsoapplytotheplaintif.Theplaintiffplaysanimportant
