欧洲食品安全零售企业自主规制及其贸易效应研究内容摘要食品安全零售企业自主规制是欧洲近十年来出现的现象。由于食品安 全的监管关系到消费者的身体健康，以往一直被认为属于公共规制的范畴。 可是，越来越多的食品安全事件的发生，使得公众不得不质疑食品安全政 府规制的效果。也就是说，人们有理由相信，在食品安全政府规制方面可 能存在着一定程度的失灵。为应对食品安全政府规制失灵的挑战，提升消 费者对食品安全的信心，欧洲企业、特别是零售企业开始通过设置或参与 行业协会的私营标准实现食品安全企业自主规制。然而，由于食品安全企 业自主规制过程中依赖的私营标准远远高于公共标准，因此对发展中国家 的农产品贸易产生了越来越显著的影响。论文主体包括四个部分。第一部分主要从食品安全保障体制中的规制与标准入手，分别比较分 析了政府规制与官方标准、企业自主规制和私营标准，以及两者之间的关 系，为后文的分析奠定了理论基础。第二部分主要分析欧洲食品安全规制体系的演变，着重分析了欧洲食 品安全零售企业自主规制的现状以及零售企业自主规制机制形成的机理。 欧洲大型零售商主导生鲜食品市场份额以及它在食品安全体系中日益重要 的角色推动了欧洲食品安全规制体系的演变。第三部分主要运用发展中国家和发达国家的贸易模型，分析零售企业 自主规制过程中产生与发展的私营标准对于欧洲与发展中国家之间农产品 贸易的影响，进而着重阐述了私营标准对发展中国家作为贸易促进者和贸 易壁垒的影响。第四部分主要从我国政府、出口企业以及出口行业协会三个维度提出 应对欧洲零售企业食品安全自主规制过程中依赖的私营标准的对策建议。关键词：食品安全，政府规制，自主规制，官方标准，私营标准THE STUDY OF EUROPEAN RETAIL ENTERPRISES SELF-REGULATION OF FOOD SAFETY AND ITS IMPACT ON TRADEABSTRACTThe retail enterprises self-regulation of food safety is a phenomenon in the past ten years. Since food safety influence the health of consumers, we think food safety is under the scope of the public regulation. But more and more food safety issues have been taken place all around the world, people begin to doubt the effectiveness of the public regulation. That is to say, we can believe that the public regulation of food safety may have some kind of failure. And in order to cope with the public failure, and enhance the consumers confidence, the European enterprises, especially retail enterprises begin to set some private standards to implement the self-regulation of food safety.
