摘要通知规则，又称提示规则，也被形象地称之为“避风港规则” ，其首创于美国。我国《信息网络传播权保护条例》第 20—23 条最早引入该规则，《侵权责任法》第36 条第 2 款也对通知规则进行了规定。由于我国对于通知规则的理论研究未形成完备的理论框架和研究方法体系，司法实践中对其存在诸多困惑。适用通知规则时法官过度的自由裁量权，高度相似的案件得到完全不同的判决结果，这些不仅损害了法律的权威和尊严，也不利于形成稳定的法律风险预期。因此，明确通知规则相关规定，厘清通知规则下网络服务提供者对侵权行为的义务界限，才能使网络中各主体的法律状态安定清晰，既保障网络用户的行为自由也维护网络秩序的健康发展。本文以通知规则为研究对象，以《侵权责任法》第 36 条为文本，运用民法解释论的方法对通知规则的含义和原理，适格通知的判定和效力，以及通知规则下网络服务提供者的侵权责任进行分析和讨论，以期对通知规则有更为清晰的认识以裨益于司法实践。文章除引言和结语外分为四个部分：第一部分，通知规则的含义与原理。明确通知规则的含义，阐释通知规则的制度目的及平衡权利人和网络服务提供者利益的机制。第二部分，比较法上的通知规则。通过深入细致地剖析美国和欧盟避风港规则，深入理解避风港规则的设计理念和适用条件，为解释我国通知规则相关规定提供理论基础。第三部分，适格通知的判定及效力。《侵权责任法》对通知的形式和实质性要件都未作出具体规定，学者对此也有不同的观点，笔者结合司法实践中具体案例分析适格的通知的判定标准及效力。第四部分，通知规则下网络服务提供者侵权责任分析。首先，明确网络服务提供者侵权责任性质，分析其承担连带责任的基础，接着，从比较法的视角以美国学术网络侵权案件中网络服务提供者责任分析为契入点，对网络服务提供者的直接侵权和间接侵权作深入研究。在我国法律未明确区分直接侵权和间接侵权的情况下，上述研究为分析我国网络服务提供者在通知规则下的间接侵权责任提供了理论基础。关键词：通知规则；网络服务提供者；间接侵权；连带责任；责任限制AbstractNotification rules, also known as tip rules, also were vividly called haven rules, first of its kind in the United States.
