我国退役运动员权利保障研究中文摘要我国竞技体育事业在北京奥运会和多哈亚运会结束后，全面进入巅峰发展阶段。众所 周知，竞技体育就像金字塔一样，少数享受光荣和闪耀的运动员，却需要无数为之默默奉 献的牺牲者。大多数的无名英雄在此过程中做出了艰辛的努力、付出了巨大的代价，却没 有获得优异的成绩，最终选择了黯然退役，重新去寻找新的出路和开始新的生活。至此我 国退役运动员权利保障问题成为我们不可回避的问题。这对我国竞技体育事业的发展有着 至关重要的影响，更从侧面体现着整个国家与社会对于我国退役运动员的关注。本文通过 四个方面关于对退役运动员权利保障问题进行论述。第一部分是关于退役运动员权利保障主题概念的阐述。人权理论和人权保障，是一切 关于权利争取得以兴起发展重要原因，任何理论学说的建立都无法规避人权的影响和作 用。其次，关于退役运动员应符合的具体条件、标准、要求等，以及地方特殊情况给予全 面归纳总结。最后，就应享核心的权利，笔者集中精力对于退役运动员当务之急需要进行 集中保护的四个权利方面进行阐述。第二部分介绍了国外对于退役运动员的权利是如何保障。首先选择具有运动员职业化 科学培养的美国，以及和我国举国体制培养运动员情况相似的俄罗斯。在亚洲，日本刚刚 借鉴西方体制完成职业化培养方法，而韩国则是政府与社会共同努力实施的社会保障的方 式。以上经验都对我国体育事业的发展与改革提供了帮助与借鉴。第三部分阐释我国目前对退役运动员权利保障的相关缺陷的三个方面。没有社会保障 的视角关注对于退役运动员的权利保护，忽略他们作为特殊人群的社会地位，没有相关的 保险保障。而我国举国体育的培养方式本身就是对人权保障的缺失，忽视运动员自身的素 质培养，导致退役后无法在社会中找寻到自己的位置。第四部分阐述关于解决退役运动员安置与发展问题的应对策略。从建议将运动员社会 保障纳入进全民的社会保障体系内到广泛退役运动员职业技能培训体系，最后关于退役运 动员社会保障机构建立的合理化建议。笔者本着以人为本、对于安置就业和投入产出的提 出了合理化建议。关键词：权利退役运动员法律Rights protection in Chinas retired athletesAbstractWith the Beijing Olympic Games and the Doha Asian Games ended, the development of competitive sports in our country has formally entered the peak.
