ResearchonseveralproblemsofcriminalillegalevidenceexclusionprocedureAbstractSincethereformandopenpolicy,ourcountrystartedtheChinesecharacteristicsocialismruleoflawconstruction,establishedthebasicstatepolicyofgoverningthecountryaccordingtolaw.Withthedevelopmentofthesocialistruleoflaw,importanceisgiventotheguaranteeofhumanrightsgradually.Constitutionalchangesin2004,towritesafeguardshumanrightsintotheconstitution,intheformoflaw,confirmthefocusofworkfortheruleoflawtosafeguardhumanrights.Aroundthetopicofprotectinghumanrights,hascarriedoutanumberofrelatedworkoftheruleoflaw.Amongthem,inMay2010,thesupremepeoplescourt,thesupremepeoplesprocuratorate,ministryofpublicsecurity,statesecurityandtheministryofjusticejointlyissuedaabouttoreviewdeathpenaltycasesjudgmentprovisionsonsomeissuesofevidenceandcriminalcaseconcerningtheprovisionsonsomeissuesofexcludingillegalevidence,hereinafterreferredtoastworulesofevidence.Followedbythecriminalprocedurelawrevisionincreasedaboutrulesofexcludingillegalevidence.Inrecentyears,alongwithextensivejudicialpublicandthesocietyfromallwalksoflife,somebeingreceivedwidespreadattention.SheXiangLincasebeganin2005,thecountryhascarriedoutontorturecriminalprocedureandentityofbigdiscussion.Whatisundeniableisthatapplicationofillegalevidenceexclusionruleinourcountry,istheembodimentofthesafeguardhumanrights,itisasignofmoderngovernmentbylaw.Ofcourse,theapplicationoftheillegalevidenceexclusionruleinourcountryhasjustbegun,andtherearemanydrawbacks.Inadditiontothemediaoftheillegalevidenceexclusionrulesapply\severalcases,lessstillappliedinthejudicialpractice.Inthepracticaljudicialwork,illegalevidenceexclusionrulesthemselvesplaythereisaproblem.Investigateitsreason,theauthorthinksthat,itisthelawoftheillegalevidenceexclusionruleitselfisnotperfect,thesecondisillegalevidenceexclusionruleinjudicialactivitiesundervariousconstraints.EuropeanandAmericancountriesintheaspectofapplicationoftheillegalevidenceeliminationruleearlier,alsomoreexperienced,therefore,candrawlessonsfromthe
