设立我国遗产破产制度研究 摘 要 伴随着社会的发展，法律同样经历了一个由简单向完善发展的过程。法律因习惯而生，也因习惯而变。我国基于当时的社会情况，颁布了强调养老育幼社会功能和保护继承人继承权的继承法，缺乏对遗产债权的保护，遗产债权的保护与继承法的社会功能和继承人利益的矛盾越来越突出，为求得两者的平衡，很有必要引入遗产破产制度。本文考察了国外遗产破产制度的沿革和功能，在对中外继承与破产制度的比较和分析的研究中，笔者认为遗产破产制度具有自身的独立性，进而对就如何设立适合我国国情的遗产破产制度进行了具体的设计,包括论述了遗产破产的立法名称、破产财团、破产程序启动、债权的确认、财产的分配和程序终结等，建立遗产破产制度才能进一步完善我国的继承和破产法治。 关键词：遗产破产；破产能力；独立性；必要性；破产财团；破产分配 图书分类号： On Building Our National System of Inheritance Bankruptcy Abstract Accompany with the development of the society, the law experienced a process from simplicity to consummation. Law is the crystallization of the habit and thought of society also cannot stand still with them .Our country issue inheritance code which emphasize the social function and ignore the protection of creditor, for balancing the interest of both parties, it is necessary to build our system of inheritance bankruptcy. This thesis has researched the origin and development and the function of inheritance bankruptcy, it is believed in that the system of inheritance bankruptcy is independent by means of studying and comparing Chinese to the other national inheritance and bankruptcy system. Further then, it has specific designed our nation legal system of inheritance bankruptcy in this paper. It demonstrated the name of inheritance bankruptcy, property of the estate and distribution of assets etc., and it will make the rule of inheritance and bankruptcy law perfect. Key words: Inheritance bankrupt; the ability of bankruptcy; Independence; Necessity; Property of the estate; Distribution of assets 前　言 社会发展表现为一个过程，一个由低级、野蛮向高级、文明发展的过程，伴随着社会的发展，法律同样经历了一个由简单向完善发展的过程。法律是传统的、习惯的。正如恩格斯指出：“在社会发展的某个很早的阶段，产生了这样一种需要：把每天重复着的产品生产、分配和交换用一个共同规则约束起来，借以使个人服从生产和交换的共同条件。这个规则首先表现为习惯，不久便成了法律。”[1]。法因习惯而生，也因习惯而变。我国几千年的封建历史，具有长期的身份继承和父债子还的传统。近代清末修律，清政府于1906年颁布了中国历史上第一部有关破产的法律《破产律》，但仅仅颁布两年就因多遭非议而被明令废止。1910年颁布《大清现行刑律》，仍带有传统“诸法合体”的色彩，其有关继承的规定大体沿袭古制，少有变革。曾仿德日民法拟成《大清民律草案》，这部法律并未颁布。国民党政府于1930年颁布继承法，实行概括继承原则下的选择限定继承制度。1935年，颁布了破产法，
