Determining WHO needs to be trained. Deciding WHAT the content should be. Choosing the frequency of training. Getting organized. Convincing Management of the Need for an FCPA Program Scary stories about other companies Bad publicity is not better than no publicity at all The law requires it Everybody else is doing it Who Needs to Be Trained? Look at your structure. Where do you do business? Who interacts with government officials? What Should the Content Be? Cover the basics. Different training for different positions. Scare tactics. Who to call for help! How Often Should Training Occur? How often do you require other training? What is reasonable for your company? Can you monitor it effectively? Get Organized! Decide on a point person. Schedule periodic reviews and updates. Keep the information handy in case it is needed. Follow current events. Scary stories – Melissa has already provided you with a few. Thankfully, I am not aware of any horror stories involving FedEx, probably because of Melissa’s help in implementing these programs. But the stories are out there, as Melissa has noted. Bad publicity – You know your management and your company better than I, but there is nothing more frightening than bad publicity. It can destroy years of image building in an instant, and having a good FCPA program is an insurance policy against that happening. Law – It’s that simple. Now, there may be some internal debate about what or how much the law requires, but it is indisputable that the law requires that any company dealing with foreign officials take some action to prevent improper influencing of government officials, and that those companies meet certain standards regarding their accounting and auditing.
