AbstractThemostprofoundchangewhichthehumansocietyisundergoingistheprogressfromIndustryAgetoInformationAge.Duringtheprocess,informationistakingovertheroleofobjectivematerialtobethemostimportantfortunecarrier,eventhefortuneitself.TheinfluenceoftheInformationAgetopatents,isthenewthingofbusinessmethodpatent’semergenceanddevelopment.Therightobjectofbusinessmethodpatentisbusinessmethodinthebroadsense.Thiskindofpatenthasthecompatibilityassameaswhatthenormalmethodpatenthas.Businessmethodpatentcouldmeettheneedsofdatamining,financialservicing,businessmodeldesigning,socialrelationshiparranging,andsoonasalmostallofthepatentremandsoftheInformationAge.Benefitedfromtheinternetandcomputer,thebusinessmethodpatentcouldbreakthroughthetraditionalregionalrestrictofpatent,whichinfactenlargesitsrightscope.Also,thecharacterofthebusinessmethodpatentasanewthing,makesthevirgin-land-cultivatinginthebasicbusinessareasmoremeaningful,thatis,patentgrantingnearlymeansoccupyingthoseareas.Thedevelopedcountriesrecognizedtheimportanceofbusinessmethodpatent,whoareundergoingtheirglobalarrangementofbusinessmethodpatent,wantingtoreproducetheirsuccessfulmodelof“technologypatentizing----patentstandardizing----standard-grantingglobalizing----technologymonopolizing”intheareaofbusinessmethodpatent.Tothecontrary,ourcountryfellbehindthosedevelopedcountriesgreatly,thereasonslieintheignorancefromthelegislation,totheadministration,andtothepractice,also,lieinthestrict“technologystandard”ofbusinessmethodpatenteligibility,whatcausedtheshortageofbusinessmethodpatentsinourcountry,andbroughtabadinfluencetothefuturecompetition.Thus,thetaskofdevelopingbusinessmethodpatentisveryurgent.Thedeferencebetweentraditionalpatentsandbusinessmethodpatent,isthatthelatter’srightobjectisbusinessmethod.Thefirstproblemofimprovingbusinessmethodpatentistosolveitseligibility.TheUSAproducedaneligibilityexaminingwayrevolving“useful”,ontheotherhand,theUN,whosticksthepatentcharacteristicoftechnology,developedadifferentway,whichrevolves“technical”
