论侵权法上的补充责任 摘要 随着现代社会的发展，各种侵权案件随之增多。为了更好地保护被侵权人的合法权益，我国民法理论界在司法实践中提出了“补充责任”这一新的责任形式。2003年12月公布的《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》（简称《人身损害赔偿司法解释》）首次对补充责任作了规定，2009年12月公布的《侵权责任法》对补充责任做了更为明确的规定。本文针对侵权补充责任的相关问题展开论述，首先阐述了侵权补充责任的概念和侵权补充责任在我国法律中的运用，其次分析了侵权补充责任的构成要件，接下来分析了侵权补充责任与其他共同责任形态的比较，最后结合案例分析了侵权补充责任的适用。以期对我国相关理论知识的进一步研究有所裨益，从而为司法实践提供有力的理论指导。 关键字：侵权法；补充责任；法律适用 Abstract With the development of modern society, all kinds of infringement cases. To better protect the legitimate rights and interests of the patentee, civil law theory put forward in the judicial practice in China added responsibility this new form of responsibility. Released in December 2003, the supreme peoples court on the trial of cases on compensation for personal injury to explain some issues of applicable law (hereinafter referred to as the judicial interpretation on compensation for personal injury) for the first time made a supplement responsibility stipulation, released in December 2009, the tort liability act made more explicit provisions to the supplement responsibility. Based on tort compensatory responsibility related issues, first expounds the concept of tort supplementary liability and tort liability in the application of law in our country, secondly analyses the components of infringement added responsibility, then analyses the tort supplementary liability compared with other common responsibility form, finally combining with the application of the supplement case analysis of the infringement responsibility. In order to help to our country for the further study of the relevant theoretical knowledge, thus providing powerful theoretical guidance for the judicial practice.
