PAGE \* MERGEFORMAT32 ********校 研究生毕业论文 论文题目： 信访制度法治化探索 班级形式： 2009级在职大集中**班 学员姓名： ** * * 学科专业： 法 学 导师姓名、职称： ***（副教授） 论文工作起止时间： 2011年10月—2012年5月 【内容摘要】信访制度是一项具有中国特色的政治法律制度，它在发挥积极作用的同时也产生了许多现实问题。分析信访制度存在的问题，探寻有效解决信访问题的路径，这在当今推动我国依法治国、构建和谐社会具有重要意义。 本文从对信访制度存在的基本价值入手，在对信访制度的功能与当前信访制度的现状及存废争议介绍分析的基础上，指出信访制度存在的问题，一是信访制度功能定位不准确;二是立法存在缺陷;三是执法过程存在问题。在深入分析信访制度缺失所造成的负面影响的基础上，笔者认为解决当今信访制度存在的问题，就是将信访纳入法治的轨道，实现信访法治化。 最后，本文对我国信访制度完善措施提出了合理化的建议，并以我国古代“信访制度”为鉴，提出我国当下信访制度的具体完善建议。一是要正确定位信访功能；二是规范信访运行，如制定我国的信访法，设置信访机构及其体系，完善信访程序设置，加强责任追究等;三是加强信访制度外部法律、政治环境的协调。 【关键词】信访制度 法治化 探索 【Abstract】The petition system is a political and legal system with Chinese characteristics, it is also produced at the same time play an active role in many practical problems. The problems of the petition system, and to explore effective solution to the path of letters and questions, which in today to promote the rule of law in China, building a harmonious society of great significance. In this paper, starting from the basic value of the petition system, based on the introduction and analysis functions for the petition system and the status of the current petition system and the abolition controversy, pointing out that the petition system problems: First, the petition system function is not accurate positioning; legislation flawed; law enforcement process problems.
